Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kapsee (https://kapsee.in), operated by Kapsee (“we”, “us”, “our”), a sole proprietorship based in India. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Kapsee.

1. The service

Kapsee provides automated speech-to-text, caption timing, light text polish, editing, and export tools (including SRT) for short-form video and audio. Features and limits depend on your plan (free trial, pay-per-reel, or prepaid 30-day pack). We do not guarantee 100% transcription accuracy — Indian accents, slang, noise, and music may reduce quality.

2. Eligibility & accounts

• You must be at least 18 years old, or use the service with a parent/guardian’s consent.
• You are responsible for keeping login credentials secure.
• Provide accurate email and billing information. One person/business per account unless we agree otherwise.
• We may suspend accounts that abuse free trials, spam uploads, or break these Terms.

3. Your content

You retain ownership of media you upload and captions you generate. You grant us a limited licence to process, store, and transmit that content only as needed to run the service (transcription, editing, delivery, abuse prevention, and support).

• Upload only content you own or are allowed to process.
• Do not upload illegal, harmful, infringing, or intimate content involving minors.
• Do not reverse-engineer, scrape, overload, or bypass plan limits.

4. Plans, payments & taxes

Prices are shown in Indian Rupees (INR) unless stated otherwise. Payments are processed by Razorpay. You authorise charges for the pack or pay-per-use order you select. Packs are prepaid for a fixed period (for example 30 days) and do not auto-renew — buy again when you want another period. Taxes (including GST where applicable) may be added as required by law. Refunds follow our Refund Policy.

5. Free trial & credits

Free trial credits (for example one verified reel) are for legitimate personal evaluation. We may revoke credits obtained via fake accounts, disposable email abuse, or automation. Failed jobs that we cannot complete typically restore the credit used, as described in the product and Refund Policy.

6. Intellectual property

Kapsee branding, UI, and software remain our property. You may not copy, resell, or white-label the service without written permission.

7. Disclaimers

The service is provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent allowed by Indian law. Captions are assistive — you are responsible for reviewing exported subtitles before publishing.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid us in the three (3) months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or lost profits.

9. Termination

You may stop using the service and request account deletion anytime. We may suspend or terminate access for Terms violations, non-payment, or legal risk. Sections that should survive (IP, liability, indemnity-style obligations) remain in effect after termination.

10. Changes

We may update these Terms. Material changes will be posted on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the Laws of India, with courts in India having exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
